COSMERALDA shall not be held contractually or non-contractually liable for any direct or indirect damage to persons and\/or property resulting from the non-acceptance, including partial non-acceptance, of an order. The Customer shall likewise have no right to claim damages or compensation for the non-acceptance, including partial non-acceptance, of an order.<\/p><p class=\"isSelectedEnd\">COSMERALDA reserves the right to change the prices of its products at any time; however, the price payable by the Purchaser shall be the price in force at the time the order is recorded and product availability is reserved.<\/p><h2>Copyright<\/h2><p class=\"isSelectedEnd\">All content available on the website <a href=\"http:\/\/www.cosmeralda.it\">www.cosmeralda.it<\/a>, including in particular texts, graphics, logos, buttons, images and audio clips, is the property of COSMERALDA and is protected by international copyright laws.<\/p><p class=\"isSelectedEnd\">The trademarks and logos reproduced on <a href=\"http:\/\/www.cosmeralda.it\">www.cosmeralda.it<\/a> are registered and unregistered trademarks of COSMERALDA in Italy and in other countries and are protected by Swiss and international copyright laws.<\/p><h2>Prices<\/h2><p class=\"isSelectedEnd\">All prices are expressed in Euros.<\/p><p class=\"isSelectedEnd\">Shipping costs are not included in the product price.<\/p><h2>Payment Methods<\/h2><p class=\"isSelectedEnd\">COSMERALDA accepts the following payment methods:<\/p><ul data-spread=\"false\"><li>PayPal<\/li><li>Credit Card via PayPal<\/li><li>Advance bank transfer<\/li><\/ul><p class=\"isSelectedEnd\">At no time during the purchasing process is COSMERALDA able to access the Purchaser\u2019s credit card information, which is transmitted through a secure connection directly to the website of the banking institution handling the transaction.<\/p><p class=\"isSelectedEnd\">No COSMERALDA computer database will store such data. COSMERALDA may therefore under no circumstances be held liable for any fraudulent or unauthorised use of credit cards by third parties in connection with payment for purchased products.<\/p><h2>Cancellation of the Order by the Customer<\/h2><p class=\"isSelectedEnd\">If the Purchaser cancels the purchase after the goods have already been shipped, the Purchaser shall bear the shipping costs for returning the parcel.<\/p><h2>Non-Payment<\/h2><p class=\"isSelectedEnd\">If payment and\/or proof of payment is not received within the established deadlines, the order shall be deemed cancelled, unless otherwise agreed in advance between COSMERALDA and the Purchaser.<\/p><p class=\"isSelectedEnd\">COSMERALDA will notify the Customer of the cancellation by email.<\/p><h2>Order Processing and Shipping<\/h2><p class=\"isSelectedEnd\">The order shall be deemed processed when the goods are handed over to the courier.<\/p><p class=\"isSelectedEnd\">As a general rule, for items immediately available in stock, COSMERALDA processes orders within three working days from receipt of payment in the case of Credit Card or PayPal payments, from the date the order is placed in the case of Cash on Delivery, or from receipt of proof of payment in the case of offline payment methods such as bank transfer.<\/p><p class=\"isSelectedEnd\">Delivery times are the responsibility of the courier and are beyond COSMERALDA\u2019s control.<\/p><p class=\"isSelectedEnd\">COSMERALDA accepts no liability for delays in processing the order or delays in delivery by the carrier.<\/p><p class=\"isSelectedEnd\">Shipping costs shall always be borne by the Customer and are therefore non-refundable in the event of a return.<\/p><p class=\"isSelectedEnd\"><strong>INTERNATIONAL SHIPPING<\/strong><\/p><p class=\"isSelectedEnd\">IMPORTANT: before placing an order, it is the Customer\u2019s responsibility to check with the customs authorities in their country regarding the conditions and documentation required for the importation of cosmetic products.<\/p><p class=\"isSelectedEnd\">The Customer is responsible for providing any documents and fulfilling any other requirements prescribed by law for the admission of cosmetic products into the destination country.<\/p><p class=\"isSelectedEnd\">COSMERALDA shall under no circumstances be held liable for orders rejected upon entry into the destination country due to lack of appropriate documentation, licences, taxes, health documentation, brokerage fees or any other administrative procedures required by the local authorities for import purposes.<\/p><p class=\"isSelectedEnd\">If the goods are returned to COSMERALDA due to failure to meet import requirements, the Customer shall be responsible for all shipping, repackaging, storage, administrative and other related costs.<\/p><h2>Inspection Upon Delivery<\/h2><p class=\"isSelectedEnd\">Upon delivery of the goods by the courier, the Customer is required to check:<\/p><ul data-spread=\"false\"><li>that the number of packages delivered corresponds to the number indicated in the shipping document;<\/li><li>that the packaging is intact, undamaged, dry and otherwise unaltered, including the sealing materials such as adhesive tape or metal straps.<\/li><\/ul><p class=\"isSelectedEnd\">Any damage to the packaging and\/or product, or any discrepancy in the number of packages or other information, must be immediately reported by adding a <strong>WRITTEN RESERVATION SUBJECT TO INSPECTION<\/strong> to the courier\u2019s proof of delivery.<\/p><p class=\"isSelectedEnd\">Once the courier\u2019s document has been signed, the Customer may no longer raise any objections regarding the external condition of the goods delivered.<\/p><p class=\"isSelectedEnd\">Both in the event of problems reported to the courier and in the event of any other issue relating to the physical integrity, conformity or completeness of the products received, the Customer must notify COSMERALDA at <a href=\"mailto:info@cosmeralda.it\">info@cosmeralda.it<\/a> within 2 days of delivery.<\/p><h2>Right of Withdrawal<\/h2><p class=\"isSelectedEnd\">The right of withdrawal is subject to the following conditions:<\/p><ul data-spread=\"false\"><li>For hygiene reasons and due to the perishable nature of cosmetic products, products that have been opened may not be returned. Products must be returned intact, with the outer packaging still sealed and in perfect condition.<\/li><li>Products whose original packaging bears labels, adhesive tape or writing will not be accepted.<\/li><li>Pursuant to applicable law, shipping costs relating to the return of the goods shall be borne by the Customer.<\/li><li>Until confirmation of receipt at our warehouse, the shipment remains entirely at the Customer\u2019s risk.<\/li><li>If the goods are damaged during transport, COSMERALDA will notify the Customer of the incident within 5 working days of receipt of the goods at its warehouse, so that the Customer may promptly file a claim against the courier chosen by the Customer and obtain reimbursement of the value of the goods, if insured. In such circumstances, the product will be made available to the Customer for return, and the withdrawal request will simultaneously be cancelled.<\/li><\/ul><p class=\"isSelectedEnd\">COSMERALDA shall under no circumstances be liable for damage, theft or loss of returned goods shipped without insurance.<\/p><p class=\"isSelectedEnd\">Provided that the above conditions are met, COSMERALDA will refund, within 7 days of the return of the goods, the full amount originally paid by the Customer or, in the case of a partial return, the amount relating to the returned items.<\/p><p class=\"isSelectedEnd\">The refund may be reduced by the value of the packaging or gift packaging if these are returned damaged or not intact.<\/p><p class=\"isSelectedEnd\">Where the goods were paid for by Credit Card or PayPal, the refund will always be made using the same payment method.<\/p><p class=\"isSelectedEnd\">If the Customer\u2019s order benefited from free or discounted shipping because the total value of the order exceeded the minimum amount required to qualify for such benefit, and the Customer subsequently exercises the right of withdrawal in respect of some or all of the items, an amount corresponding to shipping and packaging costs will be deducted from the refund due to the Customer, unless the Customer retains items whose total value still exceeds the minimum amount required to qualify for free shipping.<\/p><p class=\"isSelectedEnd\">In this case, the contribution deducted from the refund shall correspond to the shipping cost indicated on the website for the shipping method used for the original shipment. In any event, such contribution shall not be less than EUR 15 for shipments within Italy and EUR 30 for shipments to other countries.<\/p><p class=\"isSelectedEnd\">In the event of a return, all shipping costs from the Purchaser\u2019s address to the COSMERALDA address shall be borne by the Purchaser, together with any customs charges and VAT payable to customs authorities.<\/p><p class=\"isSelectedEnd\">COSMERALDA will provide the best possible assistance with customs clearance.<\/p><p class=\"isSelectedEnd\">The Purchaser is required to provide any documentation requested for customs clearance.<\/p><h2>Complaints<\/h2><p class=\"isSelectedEnd\">Any complaint must be sent by email to <a href=\"mailto:info@cosmeralda.it\">info@cosmeralda.it<\/a> or by post to:<\/p><p class=\"isSelectedEnd\">SardegnaSummer Srl<br \/>Registered Office: Via Donatori di Sangue 25<br \/>08100 Nuoro (NU)<br \/>Italy<\/p><h2>Applicable Law<\/h2><p class=\"isSelectedEnd\">The sales contract between the Customer and COSMERALDA shall be deemed concluded in Italy and governed by Italian law.<\/p><p>Any dispute arising from the concluded contract shall fall under the sole and exclusive jurisdiction of the Court of Nuoro.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>General Terms and Conditions of Sale Conclusion of the Contract The contract entered into between COSMERALDA and the Customer shall be deemed concluded upon acceptance of the order by COSMERALDA, even if such acceptance concerns only part of the items ordered by the Customer.
